Your account will be setup and activated after payment for the services being purchased has been made, and we and/or our payment processor has screened the order for possible fraud. It is solely your responsibility to ensure that that you provide us with a current email address which must not be located at the domain name you are signing up for at All Star Hosting. This email will be used as the primary contact email in case of abuse or other issues related to the services you have subscribed to. It is your responsibility to ensure that such email address on file at All Star Hosting is kept up to date and current at all times. The provision of false contact information of any kind may result in the immediate termination of all accounts you may hold at All Star Hosting. If these requirements are not met, the order may be considered fraudulent in nature and denied.


The use of the services provided by All Star Hosting may only be used for those purposes deemed lawful by the laws of the State of Florida, the State of Missouri, the State of Texas, and the United States of America. By using our services you accept all liability for any claims resulting from the use thereof. You also agree to indemnify and hold All Star Hosting harmless from any claims or other liabilities which you may incur. You may not use our services for any uses comprising infringement upon any copyright, trademark, goods, slogans, etc. This includes but is not limited to unauthorized copying of music, books, photographs, or any other copyrighted work. The offering of counterfeit merchandise or otherwise not complying with the rules set forth comprises a breach in this agreement, and constitutes grounds for the termination of your account. If you believe that one of our customers is infringing upon one of your copyrights or trademarks, please email us using our Web Form. When submitting a claim it is your responsibility to provide all necessary information/proof of ownership so that we may investigate the issue.

Examples of unacceptable material on our servers include, but are not limited to: IRC Bots, Proxy Scripts / Anonymizers, Pirated Software / Warez, image, filedump, mirror, or banner-ad services (similar to rapidshare, photobucket, or commercial banner ad rotation), affiliate servers, topsites, commercial audio streaming (more than one or two streams), Escrow, High-Yield Interest Programs (HYIP) or related sites, Investment sites (FOREX, egold exchange), sale of any controlled substance, AutoSurf sites, Bank Debentures, Bank Debenture Trading Programs, Prime Banks Programs, lottery sites, muds / rpg's, hate sites, hacker focused sites/archives/programs, or sites promoting illegal activities, IP Scanners, Brute Force Programs, Mail Bombers and Spam Scripts. Forums and or websites that distribute or link to warez content are prohibited.

We do not allow any forms of indecent, pornographic, explicit, or otherwise sexually oriented material and/or content of any kind to be hosted, linked to, or otherwise promoted by any site hosted on our servers. A report of such a violation constitutes grounds for and will result in the immediate termination, with or without notice, of any accounts you may hold with All Star Hosting. Any content made available in violation to the laws of any/all aforementioned jurisdictions, will be reported to the appropriate law enforcement agency.

The use of your account for backup and/or storage purposes is not permitted, with the exception of one backup of your sites content and or settings.

It is your responsibility to ensure that all scripts and programs installed on your account are not vulnerable to hackers, and that permissions of directories and files are set properly, in order to increase the difficulty of gaining unauthorized access. When possible you should set permissions on most directories to 755 or otherwise as restrictive as possible. Users are responsible for all actions taken under their account. You must not use weak login credentials. If our system is breached due to your weak login credentials your account may be suspended until you agree to use more secure credentials. Audits may be done to determine if weak passwords are being used. If weak passwords are being used, you will be notified and requested to change or update your password to one deemed more secure.

Failure to respond to emails regarding abuse or TOS violations within 48 hours may result in your account and/or other services being suspended and/or terminated.

We reserve the right to refuse service to anyone, upon any grounds. Any material that, in our judgment, is in violation of our TOS in any manner may be removed from our servers or disabled, with or without prior notice.


User may not:
• Use 25% or more of system resources for longer than 90 seconds.
• Run unattended server processes or daemons at any point in time on the server.
• Run any web spider, indexers, or other similar robots
• Run any software that interfaces with IRC networks.
• Run bit torrent applications, trackers, or clients. You may, however, link to torrents run off site, as long as they are fully legal.
• Participate in any file-sharing/peer-to-peer activities
• Run any gaming servers
• Run cron entries with intervals of less than 30 minuets.

When using PHP include functions for including a local file, include the local file rather than the URL. Instead of include("http://yourdomain.com/include.php") use include("include.php")


Each user is alloted bandwidth on a monthly basis. This allotment may vary according to the hosting package purchased. If at any time your account exceeds bandwidth limitations, we reserve the right to suspend the account until the start of the next allocation. Unused bandwidth won't and cannot be rolled over to the next month.


We do not allow any spam to be sent via our servers. All unsolicited e-mail, bulk emailing, and other unwanted e-mail will be treated as spam. Any user who sends out spam will have their account suspended or terminated (determined by severity of said violation) with or without notice.

You may send e-mail out to a list, if and only when, every e-mail address has been specifically added to that specific list by the owner thereof.

Sites advertised via spam may not be hosted on our servers. This includes, but is not limited to spam sent via email including that sent out from third-party servers. No entity listed in the ROKSO may be hosted on our servers. Any account which results in one of our IPs being blacklisted will be immediately suspended and/or terminated.

All Star Hosting reserves the right to require changes be made to any website or account which doesn't comply with it's said policies, or make such changes in emergency situations, which shall be determined at it's sole discretion.

All Star Hosting reserves the right to charge a cleanup fee to any account holder that used our services to send any e-mail classified above as spam. This amount of said fee will fall entirely under the discretion of All Star Hosting.


Your use of our services is an acceptance by you of all risks pertaining to your site and data therein. In the event of data/file loss, All Star Hosting will not be held liable for any data, files, or other information residing on in your account that were lost and deemed unrecoverable. We recommended that you periodically make full backups of all data contained on your account that in event of such data loss on our servers you will be able to restore your data.


You agree to supply All Star Hosting with appropriate payment for the services you have chosen to sign up for, prior to the time period during which such services are provided. All services will be automatically billed on a recurring basis unless you notify All Star Hosting of your desire to cancel your services in whole or in part.

It is solely your responsibility to maintain accurate and up to date payment information and to ensure that payment is made for any and all services. All Star Hosting grants you a 15 day grace period from the time the invoice is due and when it must be paid. In the event that your invoice is not paid after the 15 day grace period, you will either be charged a $10 late fee and/or have your account suspended until the account balance has been paid in full.


In the event that you may choose to cancel the service you hold with us, it must be done in writing thru our e-mail contact form or submitting a ticket to support. Once we have received and verified necessary information with you, we will inform you that your account has been canceled. In the event that you cancel your account, you recognize that all files and other data contained on your account will be deleted within 10 days of cancellation.

Please specify your preference of having your account terminated immediately or remaining active up until the next billing cycle. Termination of your account prior to the fulfilment of 50% the accounts initial term, will revoke any rights to any and all free domains that may have been issued at the time of signup. In the event you choose to terminate your account prior to said time and still wish to retain rights to the free domain name, you will be charged for a one year domain purchase and allowed to then freely tranfer to a registrar of your choice.


All Star Hosting will grant first-time account holders a full refund for the account if requested within 45 days of the initial purchase. After 45 days, refunds will be given on a prorated basis according to the days of service remaining. It is up to the sole discretion of All Star Hosting for the final refund amount. Domain name purchases, administration fees, custom software installations, and customers that have previously held accounts with us will not be refunded. Any violation of the terms of service set forth herein will nullify any refund you would otherwise be entitled to.


All Star Hosting reserves the right to at any time modify the pricing or package details of any hosting package. In the event that any changes might affect you in a negative manner you will be notified of such changes prior to their taking effect.


Any disputes arising from the use of any All Star Hosting services will be arbitrated by a moderator of All Star Hosting's choice. All decisions made by the moderator will be final and binding. You are also made responsible for any and all costs related to such arbitration.


In no event shall All Star Hosting be made liable for any special, indirect, incidental, or consequential damages (including, but not limited to, procurement of substitute goods or services: loss of use, data, or profits: or business interruption) arising in any way out of the use of the services of All Star Hosting or the actions of any employees thereof, however caused and whether under theory of contract, tort (including negligence), strict liability or otherwise, even if All Star Hosting has been advised of the possibility of such damage.

All Star Hosting reserves the right to terminate your account for any reason and at any time with or without notice.


Upon lawful request, All Star Hosting may disclose any account holder's information to law enforcement agencies without further consent or notification to any/all affected users.


All Star Hosting reserves the right to revise any of it's policies at any time. The modification of any such policies will include the update of a modification date located near the end of such document. Users will be notified via email of any substantial changes and/or modifications that All Star Hosting shall deem nessecary that a notification be sent.
